General terms and conditions of sale

Confirmation of an order implies the customer's acceptance of these general terms and conditions of sale.

1. Confirmation, modification and cancellation of orders

All orders must be placed at least 48 hours in advance.

For custom quotes and large scale events (receptions, weddings etc.), orders must be placed at least 1 month before the event.

Any order is only definitively recorded when it has been confirmed either by e-mail or by an order form.

Any modification or cancellation of the order must be sent by email to "Pâtisserie Joséphine" at least 48 hours before the event or the delivery of the order. Any modification must be accepted in writing by "Pâtisserie Joséphine" to be valid. "Pâtisserie Joséphine" reserves the right to demand full or partial payment of the costs incurred in the event of late cancellation.

For large events, a 50% non-refundable deposit will be required to reserve your order and date. An order will only be valid and confirmed when the order form is signed and the deposit paid.

The remaining balance will be due 2 weeks before the event. In the event that the remaining balance has not been paid, the order will be considered null and void.

2. Validity of tailor-made quotes

Offers made by "Pâtisserie Joséphine" are valid 30 calendar days after their issue (date of the estimate). After this deadline, "Pâtisserie Joséphine" reserves the right to make modifications according to economic conditions and the evolution of raw material prices, the applicable rates being those in force on the day of the service.

Any service (merchandise, beverages, equipment...) not included in the estimate will be invoiced in addition.

3. Quality objective

In order to guarantee the quality and freshness of the products, "Pâtisserie Joséphine" remains dependent on the market and reserves the right to replace articles initially planned with others, equivalent in quality.

The company "Pâtisserie Joséphine" can under no circumstances be held responsible for poor preservation of the products by the customer.

4. Shipping & Returns

The delivery of an order will be invoiced on a flat-rate basis depending on the place of delivery.

Delivery of the order to the customer is carried out against the signature of a delivery note and the control of the conformity of the order.

5. Invoicing

The prices displayed on the quotations or on the flyers/website of the company "Pâtisserie Joséphine" are mentioned in € including VAT, excluding transport costs.

Orders that are collected are payable in cash.

For large events, a 50% non-refundable deposit will be required to reserve your order and date. An order will only be valid and confirmed when the order form is signed and the deposit paid.

The remaining balance will be due 2 weeks before the event. In the event that the remaining balance has not been paid, the order will be considered null and void.

Any amount not paid on the due date mentioned on the invoice shall automatically and without prior formal notice produce late payment interest at a rate equal to one and a half times the legal interest rate, to which shall be added the costs inherent to the delay. All costs of recovery by judicial or extrajudicial means as well as by way of lump sum compensation a supplement of 20% of the total amount due, in addition to the legal fees incurred by "Pâtisserie Joséphine" due in excess, are payable by the client in the event of non-payment of invoices on their due date.

6. Customer obligations and complaints

Upon delivery or collection of the order, the customer is required to immediately ensure its conformity.

To be taken into account, any complaint must be received by "Pâtisserie Joséphine" in writing within 24 hours of the order being picked up. When an order is delivered, any complaint must be made at the time of delivery and mentioned on the delivery note.

Any dispute concerning invoicing must be sent by recorded mail and can no longer be taken into account after a period of 8 days after the date of the invoice.

7. Liability and insurance

The risks of loss, breakage and damage to the goods present at the place of receipt remain the effective responsibility of the customer. Thus, it will be up to the customer to insure at his own expense the value of the goods present at the place of receipt.

8. Force majeure

The company "Pâtisserie Joséphine" is released from any liability in the event of force majeure (demonstrations, strikes, traffic jams, exceptional weather conditions, damage to the facilities of the company "Pâtisserie Joséphine" etc...).

9. Applicable law

These General Terms and Conditions and all transactions referred to herein are subject to Luxembourg law. The jurisdiction of the place of the registered office of the company "Pâtisserie Joséphine" has exclusive jurisdiction.
